Terms of Service

1. Agreement
These Terms of Service (the "Terms") are an agreement between you and One with the Sea, LLP ("Forge", "we", "us") governing your use of the Forge application and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Your account
You must provide a valid email address to create an account. You are responsible for activity that occurs under your account and for keeping access to your sign-in email secure. Forge accounts are passwordless: sign-in is by email link or a supported identity provider.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service.
3. Your content and ownership
You own what you make. As between you and us, you retain all rights to the creative content you create, upload, or generate with the Service, including scripts, characters, worlds, images, video, audio, and voice recordings (your "Content").
You grant us a limited license to host, store, process, and display your Content solely to operate and provide the Service to you. This license ends when you delete the Content or your account, except for copies held briefly in routine backups.
You are responsible for your Content, including having the rights to any material you upload (for example scripts, images, or reference likenesses).
4. Acceptable use
You agree not to use the Service to: violate any law; infringe the intellectual-property, privacy, or publicity rights of others; generate depictions of real people without the rights to do so; create content that sexualizes minors or exploits or harms children in any way; harass, defame, or threaten others; distribute malware; probe, disable, or overload the Service; or resell access to the Service without our written permission.
We may suspend or terminate accounts that violate this section. Where our media providers enforce their own content policies, generation requests may additionally be refused by those systems.
5. Credits, plans, and payment
Some features consume credits. Credits are purchased or granted under a plan, are not currency, have no cash value, and are non-transferable. Except where required by law, credit purchases are non-refundable once the associated generation work has been performed.
Payments are processed by Stripe. We do not store your full card details. Prices and plan features may change; changes apply prospectively and will be communicated before they take effect.
6. The Service and third-party providers
Generating media requires third-party model and infrastructure providers acting as our processors (see the Privacy Policy for the current list). The Service depends on their availability; output quality and availability may vary.
The Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or that generated output will be fit for any particular purpose.
7. Limitation of liability
To the maximum extent permitted by law, One with the Sea, LLP will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose or one hundred US dollars (USD 100).
Some jurisdictions do not allow certain limitations; in those jurisdictions the limitations apply to the fullest extent permitted.
8. Termination
You may stop using the Service and delete your projects at any time. We may suspend or terminate your access for breach of these Terms, with notice where practicable. Sections 3 (your ownership), 7, and 9 survive termination.
9. Governing law and disputes
These Terms are governed by the laws of the State of [STATE], United States, without regard to conflict-of-law rules. The courts located in [STATE] will have exclusive jurisdiction over disputes arising from these Terms or the Service, and each party consents to personal jurisdiction there.
10. Changes to these Terms
We may update these Terms from time to time. If a change is material we will notify you by email or in the app before it takes effect. Continued use of the Service after a change takes effect constitutes acceptance.
